Terms of Service

1. Acceptance and service operator

By accessing or using Motiona, you agree to these Terms, the Privacy Policy, Acceptable Use Policy, and Refund Policy. Motiona is provided by the operator identified in the applicable checkout and transaction receipt; Creem acts as Merchant of Record for applicable transactions and handles payment collection, taxes, billing, and parts of the refund process.

2. Accounts and eligibility

• You must be at least 18 and provide accurate, current information.
• You must safeguard login credentials and are responsible for account activity.
• You may not resell accounts, evade limits, automate abusive use, or access another account without permission.

3. AI service and third-party models

Motiona is an independent creative interface and workflow product that uses third-party AI models and infrastructure. Motiona is not affiliated with, endorsed by, or acting on behalf of those model providers. Models, availability, speed, and output quality may change.

AI outputs may be inaccurate, incomplete, similar to other content, or unsuitable for a particular purpose. You must review outputs before publishing, commercial use, or reliance and remain responsible for how you use them.

4. User content and intellectual property

You retain rights you hold in lawful content you submit and grant Motiona a limited, worldwide, non-exclusive license needed to operate, secure, and improve the service. You confirm you have the rights required to upload and process the material and that it does not violate privacy, publicity, copyright, trademark, or other rights.

Subject to applicable law and third-party model terms, you may use generated results. Motiona does not guarantee exclusivity, registrability, or non-infringement of any output.

5. Credits, pricing, and payments

• Motiona credits are usage units for generation services only; they are not currency, deposits, securities, or transferable property.
• Prices, taxes, and purchase details are shown before checkout. Purchases are one-time unless explicitly identified as subscriptions.
• Credits are deducted when generation begins; when a system or model submission fails before service is delivered, credits are generally returned automatically.

6. Content safety and enforcement

User prompts sent to image or video models are screened before generation. You must follow the Acceptable Use Policy. We may block requests, remove content, limit features, suspend or terminate accounts, and retain or disclose records when legally required.

7. Availability, disclaimers, and limits of liability

The service is provided “as is” and “as available.” We do not guarantee uninterrupted or error-free operation or that outputs will meet your expectations. To the maximum extent allowed by law, Motiona is not liable for indirect, incidental, special, punitive, or consequential damages; aggregate liability is limited to amounts you paid for Motiona during the 12 months before the claim.

8. Termination, changes, and contact

You may stop using the service and request account closure. We may suspend or terminate service for illegality, fraud, security risk, unpaid amounts, or material breach. We may update these Terms; continued use after an update constitutes acceptance of the revision.
